Online Credit Card Contract Terms & Conditions

This contract is binding between KALEIDOSCOPE EVENT LIGHTING INC. and the person who is named on the invoice and noted in this form.

By completing this form, you agree to the following contract terms:

  • I agree to pay the full amount of the invoice 30 days before event date.
  • A payment of 50% is due ASAP to lock in date and estimate rate.
  • I agree to not reverse the charge for any reason. If a situation were to arise where I felt entitled to a refund, I agree to communicate with KALEIDOSCOPE EVENT LIGHTING INC. directly.

Cancellation Policy

As a specialized company, we only accept a few number of events on one day. This allows us to maintain a high level of quality and ensure that our design meets our high standard of excellence. Due to this limit, we are committing to your event when this contract is signed and refusing other clients who may be interested in using our services on your event date. Therefore there are no refunds due to cancellation at any time and your full amount is due regardless of cancellation or circumstances.

Contracts are to be paid in full a minimum of 30 days prior to event unless otherwise discussed and approved in writing by KALEIDOSCOPE EVENT LIGHTING INC. All payments received are non-refundable.

If KALEIDOSCOPE EVENT LIGHTING INC. cancels due to issues on our part or does not render services on the date of the event due to mishaps on our side, you will be entitled to a complete refund.

Changes

Additions can be added up to 2 weeks prior to the event date. Any change after this time may incur a convenience fee. Any change to your contracted lighting package may increase your overall cost. These additional charges will be charged to your credit card on the day of the event.

Liability

Client will be liable and will hold KALEIDOSCOPE EVENT LIGHTING INC. harmless for any personal harm or property damage incurred at the venue that is due to harmful acts carried out by the client or guests of the client. Similarly, KALEIDOSCOPE EVENT LIGHTING INC. will be liable and will hold the client harmless for any personal harm or property damage incurred at the venue that is caused by the negligence of the staff/employees of KALEIDOSCOPE EVENT LIGHTING INC. (i.e. KALEIDOSCOPE EVENT LIGHTING INC. employee materially damages wall in venue). KALEIDOSCOPE EVENT LIGHTING INC. will not be held responsible for damages due to equipment failure which is out of our control. For the sake of clarity, KALEIDOSCOPE EVENT LIGHTING INC. will not be liable for personal harm or property damage at the venues that is due to "an act of God" that is beyond the control of the parties.

Weather Clause

No refunds will be given due to inclement weather. We reserve the right to refuse setting up outdoor service without refund if our technicians deem the area unsafe to set up equipment (high winds, lightning, rain etc) or if it is raining during time of setup. Equipment cannot operate in the rain due to electrocution hazards. If you choose to implement a safe rain backup plan 8 days prior to your event date, we will gladly exchange your lighting package to an alternative option that will work with your backup, however, this will depend heavily on equipment availability at the time and the new design will be based on our discretion. Furthermore, a redundant backup plan can be purchased at an additional cost to reserve the equipment needed for your backup plan and have it on the truck so that a decision can be made on the day of the event. However, there must be ample time to setup the package. Consult your lighting designer for the appropriate time needed to setup each package prior to the event day so your timeline can accommodate.

Photography

At any given time we may capture images of your event with our lighting. We reserve the right to use these images for our advertising purposes. We will not capture faces of your guests or bridal party.

Custom Colors

Custom colors will be set the day of the event. These will be as close to the swatch (if provided) or specified color(s). Once a custom color is set it will remain for the duration of the evening unless otherwise specified in your invoice. If power goes out the fixtures will no longer maintain the custom color, but will go to a default blue. We are not responsible for power outages, or color change due to uncontrollable circumstances. Custom colors cannot be guaranteed accurate to your desired color as we are using a color mixing light to accomplish this color. Color variation may be evident.

Time

We accept the time specified on the invoice as the final for the event. We will schedule our technicians for the times noted on the invoice. If the times change, or are not accurate, you will  be charged an additional fee for labor. If your end time exceeds the time stated on the invoice by more than 30 minutes. You will be billed $65 per hour past the above stated time for the total number of technicians specified on your invoice. You agree to pay this additional bill within 7 days of your event. Charges are in increments of 1 hour. You may change your times up to 14 days prior to your event without any fees.

Attorney’s Fee Provision

In the event of a lawsuit, the prevailing party shall have the right to collect from the other party its' reasonable costs and necessary disbursements and attorneys' fees incurred in enforcing this agreement.

Electrical

Each venue has different policies concerning the use of power. At times it is necessary to order additional power for your lighting package. We will let you know our power needs, and will furnish the venue with our needs on request, but you are ultimately responsible for making sure you have adequate power order/supplied in the room or location. We are not responsible for power, or costs associated with power.
